END USER LICENSE AGREEMENT ("EULA")
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE DOWNLOADING OR USING THE PRODUCT. BY DOWNLOADING OR USING THE PRODUCT, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT DOWNLOAD OR USE THE PRODUCT.
This End User License Agreement ("EULA") is a legal agreement between you and Glitchedtones governing your use of the sound packs and software products (the "Product") offered by us through our online music production store (the "Store").
LICENSE GRANT
Subject to the terms and conditions of this EULA, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Product for personal, commercial, and non-commercial use. You may use the sounds in any commercial projects, including but not limited to music productions, advertisements, and film productions, without the need to pay any additional royalties.
INTELLECTUAL PROPERTY
The Product is owned by us and our licensors and is protected by copyright laws and international treaties. You acknowledge that you have no ownership or proprietary rights in and to the Product and that your use of the Product is subject to this EULA.
RESTRICTIONS ON USE
You may not resell, distribute, sublicense, or otherwise transfer the Product, or any part thereof, to any third party.
DISCLAIMER OF WARRANTIES
THE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE PRODUCT WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ASSUME THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE PRODUCT.
LIMITATION OF LIABILITY
IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PRODUCT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY TO YOU FOR ANY CLAIM WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT.
TERMINATION
This EULA shall terminate automatically if you fail to comply with any of the terms and conditions of this Agreement. Upon termination, you must immediately cease all use of the Product.
GENERAL
This EULA shall be governed by and construed in accordance with the laws of the United Kingdom. This Agreement constitutes the entire agreement between you and us with respect to the subject matter hereof and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether oral or written. If any provision of this EULA is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Our failure to enforce any provision of this EULA shall not be deemed a waiver of such provision nor of the right to enforce such provision.
